Foreclosure and Probate

The incapacity or death of a mortgage borrower creates mass confusion for everyone involved. The borrower’s family doesn’t know their options and cannot speak with the lender. The lender cannot identify who has authority on the account. And everyone’s lawyers are stuck in the middle. Matt Hulstein of CVLS will speak on probate/foreclosure crossover cases and help identify the best path forward for your clients.

General Foreclosure Loss Mitigation Overview

Even though the foreclosure crisis is over, many loss mitigation programs remain. These options often offer better outcomes that traditional litigation. CVLS Staff Attorneys Matt Hulstein and Gabe Borges will give a brief overview of what options are available. Reinstatement, repayment, forbearance, modification, short sale, deed-in-lieu, and consent judgment alternatives will be reviewed for both conventional and reverse mortgage loans.

Reverse Mortgage Litigation

CVLS has seen a drastic increase in foreclosures concerning a reverse mortgage. We’ve seen cases involving mortgage scams, phony defaults, and a variety of servicing abuses. In this training, Staff Attorney Gabriel Borges and JMLS Law Professor Dennis Smith will review the basics of reverse mortgages, types of loan defaults, loss mitigation options, and potential claims and defenses.

General Foreclosure Defense

Foreclosure can be an intimidating area of law to practice. It is full of acronyms, arcane terms, and a plethora of loss mitigation programs and regulations. Staff Attorney Matthew Hulstein will cover the basics: the Illinois Mortgage Foreclosure Law (IMFL), loss mitigation concepts, servicing requirements, and how to assess and reach your client’s goals.
