(CH – Administrative Review – Denial of In-Home Aide) Client’s 17-year-old son lives with cerebral palsy and requires feeding tube, in-home assistance with dressing and bathing himself. Between 2015 and 2021, son was eligible for 40 hours of in-home nursing services through Medicaid. Son was not hospitalized during these years and services were renewed each year. In 2021, the Illinois Department of Healthcare and Family Services reduced son’s in-home nursing hours to zero, on grounds that absence of hospitalizations during past year showed services were unnecessary. IDHFS did so despite recommendation from son’s treating physician and testimony from son’s nurse at administrative hearing that son continues to require nursing services. Volunteer would challenge IDHFS’s decision in court and pursue the reinstatement of son’s nursing services.
