(Advanced) BREACH OF CONTRACT / EVICTION: Client (owner) and Adverse Party (tenant) entered into a “rent to buy” agreement for Client’s home in 2011. The agreement was drafted by an attorney and subsequently modified to lower payments in 2013, but the other terms remained in place. Adverse Party has made sporadic payments for the life of the contract, and completely stopped making payments in December 2019. Client moved in with her ailing father when Adverse Party began renting the Property, but has been paying the mortgage and HOA fees on the property throughout Adverse Party’s tenancy. Client’s father recently passed, and she and is having trouble making ends meet without Adverse Party’s payments. Client wants to take back possession of the home and (if possible) pursue monetary damages.
